1. Acceptance of Terms
By registering for, accessing, or using Restofyer, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, you must not use our Services.
2. Eligibility
To use Restofyer, you must:
- Be at least 18 years old.
- Have the restaurant business or any other food businesses
- Provide accurate and complete registration information like email, phone number, Menu etc
3. Account Registration
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Promptly notifying Restofyer of any unauthorized access or security breach.
Restofyer is not responsible for losses resulting from unauthorized use of your account.
4. Subscription & Billing
Subscription Plans
Restofyer offers Monthly, Yearly, and Longlasting subscription plans.
Payments
- Subscription fees must be paid in advance.
- Fees are non-refundable unless otherwise specified.
- Failure to make payment may result in suspension or termination of services.
Pricing Changes
Restofyer reserves the right to modify pricing at any time. Existing subscribers will be notified in advance of any pricing changes.
5. Free Trial
Restofyer may offer a free trial period.
- Free trials are provided solely for evaluation purposes.
- Restofyer reserves the right to modify or discontinue free trials at any time.
- Abuse of free trial offers may result in account suspension.
6. User Responsibilities
Users agree not to:
- Use the platform for unlawful purposes.
- Upload malicious software, viruses, or harmful code.
- Attempt unauthorized access to servers, databases, or other accounts.
- Reverse engineer, copy, modify, or redistribute the software without written permission.
7. Data & Privacy
Restofyer respects your privacy.
- Customer data remains the property of the restaurant/business owner.
- Restofyer may collect technical and usage information to improve services.
- Data is handled in accordance with our Privacy Policy.
8. Service Availability
While we strive for uninterrupted service, Restofyer does not guarantee:
- Continuous availability.
- Error-free operation.
- Compatibility with all devices or internet connections.
Scheduled maintenance or unforeseen technical issues may occasionally affect service availability.
9. Intellectual Property
All software, content, branding, logos, designs, features, and technology associated with Restofyer are the intellectual property of Restofyer.
Users may not:
- Copy or reproduce the platform.
- Sell, license, or distribute any part of the software.
- Use Restofyer trademarks without permission.
10. Third-Party Integrations
Restofyer may integrate with third-party services including:
- Payment Gateways
- SMS OTP Services
- WhatsApp Notifications
- Cloud Hosting Providers
Restofyer is not responsible for interruptions, errors, or issues caused by third-party services.
11. Limitation of Liability
To the maximum extent permitted by law:
- Restofyer shall not be liable for indirect, incidental, or consequential damages.
- Restofyer’s total liability shall not exceed the amount paid by the user during the preceding 12 months.
This includes losses related to revenue, business interruption, data loss, or operational delays.
12. Suspension & Termination
Restofyer reserves the right to suspend or terminate accounts that:
- Violate these Terms.
- Engage in fraudulent or unlawful activities.
- Fail to pay subscription fees.
Upon termination, access to the platform may be restricted immediately.
13. Data Backup
Users are encouraged to maintain independent backups of important business data. While Restofyer implements backup measures, we do not guarantee recovery of lost data in all circumstances.
14. Updates & Modifications
Restofyer may introduce:
- New features
- Security updates
- System improvements
- Service modifications
Continued use of the platform constitutes acceptance of such updates.
15. Indemnification
Users agree to indemnify and hold harmless Restofyer, its employees, partners, and affiliates from any claims, damages, liabilities, or expenses arising from misuse of the Services.
16. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts located in India.
